Alaska does not specifically require a license for repossession companies or repo agents, however any repo company is required to have an Alaska Business License. There is no requirement for a lien holder to notify a debtor in advance of a repossession. Though if the loan agreement was signed in a state that does require such notification then that states laws should be followed regarding the debtor's right to cure notification. Each city in Alaska has specific laws regarding notification of law enforcement officials whenever a repo is performed. Some cities require that law enforcement be notified as soon as you enter their municipality to perform a repo. Other cities simply require notification of a repo within 1 hour of a repo being performed. Make sure the repo company you hire is up to date on all local laws or your company may be penalized for your repossessor's mistakes. Federal law mandates through section 9 of the Uniform Commercial Code that Self help collateral recovery is allowed without a court order, provided there is no breach of the peace. Lien holders are also required to offer a right of redemption, which allows the consumer to regain possession of their collateral by paying the loan balance in full within fifteen days.

Alaska is a unique place to perform repossessions. Anchorage is much like most cities and we perform repo services here on a daily basis. There are dozens of cities in Alaska like Nome that does not have roads that connect to any other city. We call cities without connecting roads, "Island cities". Recovering collateral in an island city in Alaska can get expensive since the only way to move your collateral out of the island city requires a ferry or barge. There are no remarketing services in any of Alaska's island cities. Alaska law does provide for lenders to remarket collateral through public auction or public sale. It has been our experience that no one in an island city is willing to bid on collateral that was repossessed from a local.

Boats, vessels and ships are standard recoveries in Alaska. Changes in federal laws regarding fishing regulations has driven many fishing boats to bankruptcy. There is no tougher repo than to take a fishing boat from a fisherman that is losing their boat. Most times the fisherman will have every other fisherman in the city there to prevent the repo man from taking the collateral. None of these may be driven on highways due to federal laws. Title State: Alaska Repossession Title and License Information refer to: Alaska Division of Motor Vehicles, 2150 E. Dowling Road, Anchorage, Alaska, 99507

Recording: Uniform Commercial Code in effect. Liens on motor vehicle must be on title for repossessor.

Recovery: Peaceful repossession permitted.

Repo Redemption: Within 10 days after retaking. If customer had paid 50% of purchase price or $500.00, a public repossession sale is required. If less than 50% or $500.00, private repossession sale is permitted.

Deficiency: Suit for balance does not bar retaking and deficiency is collectible. Confession of judgment notes are valid for repossession.

Special Motor Vehicle Repo Provisions: Lien must appear on title to be effective for repo as to third parties.

Documents Required to Transfer Ownership of Repo Motor Vehicle: Repossession Title in debtor's name or lien holder with certified copy of lien instrument to repossessor. Certificate of registration. Registration fee: $5.00.

Repossession Plates: Remain with the repo vehicle. (Except for personalized plates.)
