The best tip
we cab give you is to not tell the person in possession of your
vehicle that you are sending out a repossessor to take the
vehicle. We understand how frustrating it can be trying to get
your customer to pay the account contractually current month
after month. You get them on the phone and they make broken
promise after broken promise. When you decide to hire a
repossessor it is because you are essentially giving up hope
that the debtor will ever pay as agreed. Your patience is gone,
in a final act of desperation you tell the debtor, "it's time to
pay today or walk tomorrow. You're trying to give the debtor one
last shot to pay up. Unfortunately, what they hear is, hide the
car, hide it now, hide it well. In the long run you are only
increasing the amount of time that the repossessor has to search
for your vehicle. Knowing that every day your collateral
depreciates more and more. Some debtors can get vindictive at
this point and intentionally damage the collateral.
It is a
violation of the Fair Debt Collection Practices Act (FDCPA) to
make payment arrangements with your debtor and then send out the
repossessor. So it's much better to tell your debtor, "Look I
know if you had the money you would be paying. I'm going to give
you some space and stop calling you every day. You call me when
you have the money together to pay your loan current." This
leaves the debtor calm and relaxed, ready for the repossessor to
swoop in and grab your collateral as quickly as possible.
This also
applies to private party repossessions where payments and money
aren't involved. If your nephew borrowed your car for the day
and is refusing to return it two weeks later, please do not tell
them you are sending out a repossessor. There is much more
emotions involved between family and friends than there is
between a bank and their customer. There have been several
instances where an individual poured gasoline inside the car and
set it on fire. In every case it has been in a private party
situation. Do yourself a favor do not tell them you are sending
a repossessor to retrieve your vehicle. This also goes for
telling your nephew's mom. Yeah, you'd like to think your sister
wouldn't tip off her son, but it happens all the time. It's
usually best to not tell anyone that you are sending the
repossessor.
