North Carolina does not license repossession companies or agents. North Carolina does not warrant that the lender notify the debtor prior to repossessing the collateral. If however, the loan was originated in a right to cure state, the lender should follow the regulations of that state. Repossessors must notify local police or sheriff as soon as any repossession is completed. The following information should be provided to law enforcement: address of the repossession, VIN number of the repossessed vehicle, license plate, name of the vehicle owner, your company name and contact information. Federal regulations demand that the peace not be breached during the repossession. Lenders are also required to advise their customer of their right to redeem any time a repossession is performed. The notification must take place in writing and let the customer know that the lender intends to sell the collateral at auction. The consumer can prevent this if they pay the loan off in full within 15 days. Their collateral will be returned to the consumer if they pay the loan off within the allotted time.

North Carolina Repossession Recording: Filed with the clerk of the Superior Court in the county where mortgagor or buyer resides; if a non-resident, recorded where the repo property is located. Liens on North Carolina Repossession motor vehicles must be recorded on certificate of title. Uniform Commercial Code adopted June, 1967.
