Repossessors are not licensed in the state of Alabama, but must adhere to the regulations set forth in the Uniform Commercial Code regarding collateral recovery. Alabama is not a right to cure state so prior notice to the debtor is not required in Alabama either. The exception to this is that the debtor may have purchased the collateral in a right to cure state and the promissory note the debtor signed may require that a right to cure notice be sent to the debtor. The Uniform Code must be followed as far as the repo company may not breach the peace while recovering any collateral in Alabama. The lien holder is obligated to send the debtor certified mail advising them of their right to redeem the collateral. The notice must state that the collateral was repossessed and that the lender intends to sell it at public auction. The notice must also let the consumer know that this process can be prevented if the consumer pays off the loan. Alabama Title and Repossession Requirements

Recording: Uniform Certificate of Alabama Title effective 1975 model vehicles, not retroactive to older vehicle regardless of Title status from other states.

Recovery: Peaceful repossession permitted in Alabama.

Repossession Redemption: Acceleration of balance, (Uniform Commercial Code supersedes all other provisions).

Deficiency: Collectible after public/private repo sale.

Special Motor Vehicle Provisions: Repeated acceptance of delinquent payments should be cured; repeated acceptance of delinquent payments interpreted as a waiver of contract. Debtor should be notified at least ten (10) days prior to sale of vehicle that same will be sold at public or private sale, (public sale not mandatory), and advised the specific amount owed (including recovery costs).

Documents Required to Transfer Ownership of Motor Vehicle: Certificate of Title, Affidavit of Repossession, Bill of Sale showing gross sale proceeds and the odometer reading, (all liens on face of Title should be released by lien holder). Repossession Title in lien holders name not required.

Alabama plates remain with the vehicle after repossession.
