The state of New York does not license repossession companies or repo agents. It is not a right to cure state so the lending institution does not have to send a consumer a notice that they are planning on repossessing the vehicle. New York state law does require that the repo agent notify the local police immediately after a repossession is completed. State law also requires that if a vehicle is repossessed in New York with New York License plates that the license plates be turned into the New York DMV within 24 hours. Under Article 9 of the Uniform Commercial Code (UCC), all repossessions must be done without breaching the peace. Following a successful recovery, the lien holder is legally obligated to provide the debtor with a formal notice of repossession and an intent to sell the collateral at auction. This notification must outline the debtor’s 15-day right of redemption, during which they may reclaim the property. To satisfy this requirement, the lender may demand a full payoff of the remaining balance plus recovery expenses, or they may allow for a reinstatement where the debtor brings the account contractually current and provides proof of insurance.

Generally speaking mobile LPR camera systems pinpoint where vehicles are parked. Mobile systems also log vehicles that are driving by our repossession trucks. If one of our trucks drives by a vehicle we have flagged as up for repo, the LPR system notifies the driver to go back and repo the flagged vehicle. Our fixed LPR cameras help us identify that a vehicle we are after passes by. Our LPR data base can be searched by license plate number and identify patterns like, the target vehicle passes by this fixed LPR camera Monday through Friday at generally the same time in the morning and afternoon, this is probably on the path to their employer. If a fixed LPR camera sees a target license plate 7 days a week at random times morning noon and night we know that this is probably very close to the home address of the debtor. Of course New York City presents a unique set of challenges for repossessors. On street parallel parking prevents tow trucks from hooking and booking. To solve this problem, all of our NYC trucks are equipped with go-jacks. If you are unfamiliar, go jacks can be placed around all four tires on a vehicle. There is a foot pedal that if you push several times lifts the tire off of the ground leaving the car supported by the 4 caster wheels on the bottom of each go jack. Once the collateral is jacked up on four go jacks our repo agent can push the vehicle out of it's parking spot sideways so that it can be picked up by our repo truck. Car sitters are another unique problem that only occurs in NYC. A car sitter gets paid to shuffle vehicles from one parking spot to another to prevent parking tickets from a vehicle being parked for over one day without being moved. Car sitters usually charge around $50 a day in NYC and will fight a repossessor to prevent losing a vehicle that represents $350 a week in income. New York Repossession Recording: Must be filed in the city or town where mortgagor or buyer resides at time of execution of the document. If non-resident, then where property is located. Uniform Commercial Code adopted September, 1964.

New York Repossession Recovery: Peaceful repossession permitted.

New York Repossession Redemption: No redemption after foreclosure and repo sale.

New York Repossession Deficiency: Permitted if provided for by the mortgage. Retaking does not bar suit for price and vice-versa. New York Repossession Confession of judgment notes are permitted.
