South Dakota does not require a repo company or repo agent to hold a license to perform repossession services. The Secretary of state does require that most businesses be registered with their department as a business. South Dakota is not a right to cure state so lien holders holders can repossess their collateral as soon as the loan is delinquent. Though in most cases the lien holder will not order a repossession until the loan is past due for two full payments. If however the loan was signed in a right to cure state then the lender should follow the repossession notification requirements of that state. Federal law requires that once a repo has taken place the creditor is mandated to notify the consumer of their right to redemption. The right to redemption allows a debtor to reclaim their property after it has been taken by a creditor. To redeem, the debtor must pay the full loan balance, plus repossession fees within fifteen days of the redemption notice. As always all repossessions must occur without the peace being breached.
South Dakota has been experiencing an oil boom for the last few years. Oil field workers, also called roughnecks have migrated mainly from Texas to work the oil fields in South Dakota. Many of these roughnecks stop paying their vehicle loans once they move here to South Dakota. Probably because they are living in company housing that is fenced in and has a gate guard. They think that they are repo proof. All week long the roughnecks have been working 10 to 12 hour days. Come Friday night the same fence that keeps the repo trucks out makes the roughnecks feel claustrophobic and they have to get out. Most of them drive off of the oil fields, get a hotel room and go drink at a local bar. Most of these areas have significant methamphetamine problems. It has been our experience that the individuals with the methamphetamine problems are the individuals that aren't making their loan payments. That's where our license plate reader (LPR) cameras come into play. When they drive into town on Friday night we have every LPR camera out there trying to find the vehicles we are after. In addition to our mobile LPR cameras we have stationary LPR cameras set up that will notify us as soon as a target vehicle we are after drives by. We start checking hotel and bar parking lots with our mobile LPR cameras till we locate and identify where it is parked at which time we land a repo truck on it and secure your collateral. The roughnecks don't stand a chance.
