Washington state does not have any licensing requirements for repo agents or repo companies. There are no regulations for a lien holder to notify a consumer that they intend to repossess their collateral in Washington. This does not apply if the loan originated in a right to cure state. If that is the case, the right to cure law of state where the load originated should be followed. Article 9 of the Uniform Commercial Code (UCC) stipulates that upon the recovery of collateral following a default, the lien holder must formally notify the debtor of their Right of Redemption. This notification, typically issued via certified mail, must confirm the repossession and state the lender’s intent to dispose of the asset at auction. The notice must specify that auction proceeds will be applied toward the outstanding loan balance; any surplus must be returned to the consumer, while any remaining deficiency may result in legal action against the debtor. Furthermore, the debtor must be informed of their right to satisfy the debt in full within 15 days to secure the return of the collateral. In all instances, the UCC strictly prohibits any breach of the peace during the execution of a recovery.
