West Virginia does not have a licensing requirement for Repo agents or repo agencies. Lenders are not mandated to notify a consumer before repossessing collateral on a delinquent loan. The exception to this is if the loan originated in a state or commonwealth that does mandate the lender notify a consumer in writing prior to repossession of their collateral. In which case the laws of the state where the loan originated should be followed. Local law enforcement must be notified whenever a repo is performed. If it occurred within city limits the local police should be called, the sheriff should be notified if the repo took place outside city limits.  Federal regulations mandate that repossessions occur without a breach of peace. Lenders must subsequently issue a written notice to the consumer explaining their right to redeem the collateral. This notice must state the lender's intent to auction the asset unless the loan is settled in full within 15 days. If the balance in full is paid within this time frame, the collateral must be returned to the consumer.
