Order an Idaho Repossession - Hold Harmless Agreement

Idaho does not have any requirement for repossessors and repo agents to be licensed. Idaho does require that the lender send a notice to the debtor informing them that they intend to seize their collateral and sell it at auction. The notice must also state the amount of money that the debtor must pay the lender in order to prevent the seizure. As always, the Uniform Commercial code requires that the peace not be breached during any repossession. Local laws require that the repo agent notify the local police or sheriff of any vehicle you repossessed, where you recovered it from and the lien holder that hired you.

Idaho farm equipment repossession

We are also adept at repossessing heavy construction equipment and farming machinery. These type repossessions require a special set of skills that most repossessors do not possess. You aren't going to just roll up on a farm and repossess a combine that weighs about 15 tons (Without the header attachment) by stealth of night without the farmer realizing you are there. Our strategy is to approach the farmer in person with all of the proper paperwork in hand and respectfully demand surrender. We advise the farmer who we are and that we have been hired by the lien holder to require some of their equipment. We explain that their options are extremely limited: 1. Pay off the entire loan balance, 2. They can voluntarily surrender the equipment immediately. 3. If option 1 or 2 are not taken immediately, the lien holder wants Speedy Repo to file a replevin action. We explain that a replevin is a court ordered seizure of the equipment that will then get the sheriff involved and that the sheriff will then be out to seize the equipment. We further that the court costs, attorney fees and the sheriff's fees will all be added to their loan balance significantly increasing the amount of money that the lender will be placing a lien on their farm. We also advise them of their federal "right to redeem" the collateral and that the lien holder is willing to extend their right to redeem from 15 days to 30 days, if they feel that would help their situation, but that they would be required to voluntarily surrender the collateral immediately to have this option available to them. Of course we get permission from the lien holder to make this offer, however, we have never had a lender  say no to this option. They are thrilled to collect the balance in full in 30 days VS having to auction the collateral off and get pennies on the dollar.

Idaho Title and Repossession Requirements

Idaho Repo Title State: Repossessor License and Repossession Registration information refer to: Idaho Repo Department of Motor Vehicles, P.O. Box 34, Boise, Idaho 83731. Tel.: (208) 334-8663. Fee for search of Repossessor records: $2.00.

Repossessor Recording: With Idaho County Recorder of Deeds or Secretary of State. Uniform Commercial Code adopted January, 1968.

Idaho Repossession Recovery: Peaceful repossession permitted in Idaho.

Idaho Repossession Redemption: No provisions for repo redemption in Idaho.

Idaho Repossession Deficiency: In chattel mortgages, only after repossession foreclosure proceedings as provided for by Idaho state law. On conditional repo sales if contract so provides. Idaho repossession confession of judgment clauses valid only on money due or about to become due in Idaho.

Idaho Special Motor Vehicle Provisions: Repo lien must appear on Idaho repossession title.

Documents Required to Transfer Ownership of Motor Vehicle: Idaho Certificate of Title in lien holders name, affidavit of repossession with Bill of Sale completed by lien holder, or repossessor.

Repo Plates: Idaho License plates remain with owner on passenger vehicles. All others, plates remain with vehicle or Idaho repossessor.
