The Montana does not maintain state-level licensing requirements for repossession agencies. As Montana is not a 'Right to Cure' state, lien holders are generally not required to notify consumers prior to recovering collateral. However, an exception exists if the original contract was executed in a state that mandates such notice, or if the language of the contract itself specifically requires prior notification. Regardless of these variables, Section 9 of the Uniform Commercial Code (UCC) mandates that the repossessor must not breach the peace while performing any recovery. The lender is also required to notify the consumer post repossession of their right to get the vehicle back if they pay off the loan in 15 days.

Montana Repossession Recording: With County Clerk and Recorder of county where property is located. Uniform Commercial Code adopted January, 1965. Must be filed with Registrar's Bureau to be valid against third party creditors.
