The commonwealth of Virginia does not have a specific license for repo agents or repo agencies. Lien holders do not have an obligation to notify a consumer that they intend to repossess their collateral when their loan is past due. Unless the loan agreement was signed in a right to cure state then that state's right to cure notice requirements must be followed. Virginia does require that repo agents notify local law enforcement any time a repossession is performed in Virginia. Under the Uniform Commercial Code (UCC), lenders have specific statutory obligations following a repossession. They must provide the debtor with a certified notice outlining the Right of Redemption and the pending sale of the collateral. This notice explains that auction proceeds will be used to pay off the loan; a check will be issued for any overage, whereas a deficiency balance may lead to a lawsuit. To avoid the auction entirely, the consumer has 15 days to pay the loan in full and reclaim their vehicle. As a standard of practice, all recoveries must be conducted peacefully, as a breach of the peace is a direct violation of the federal law.

Virginia Repossession Recording: Recorded in office of Clerk of the Circuit Court of the county where repo property is located, if it is located in a city, then with the Clerk of the Corporation Court. Uniform Commercial Code adopted January, 1967.

Virginia Repossession Recovery: Peaceful repossession permitted.

Virginia Repossession Redemption: The State allows the debtor ten (10) days to redeem repo.

Virginia Repossession Deficiency: Judgment notes are valid. Repo does not bar suit for price and vice-versa.

Special Virginia Repossession Motor Vehicle Provisions: Liens must appear on the certificate itself and no other recording is necessary.

Virginia Repossession Documents Required to Transfer Ownership of Motor Vehicle: Title in lien holder's name.

Virginia Repossession Plates: Remain with the owner and are transferable to repossessor.
