Repossession agencies must have a physical address In Indiana and have insurance for $1 million per claim. Repossessors can't charge consumers a fee for recovery of personal property from vehicles repossessed in Indiana. Indiana is not a right to cure state so the lender does not have to notify the consumer in advance of the repossession taking place. If however the loan originated in a right to cure state or if the loan agreement requires the lender to give the consumer advance notice of the repossession, then the lender must follow those terms. Local laws require the repossessor to notify the local police within 1 hour of the repossession taking place. Federal demands that the repossessor not breach the peace while performing the repossession.

Indiana Repossession Recording: With Indiana County Recorder of county where mortgagor resides: if non-resident, where goods are located. Uniform Commercial Code adopted July, 1964.

Indiana Repossession Redemption: Prior to repossession foreclosure for chattel mortgages and within 21 days of repossession for conditional sales contracts.

Documents Required to Transfer Ownership of Repo Motor Vehicle: Title in owner's name showing lien (if possible to obtain). Certified true copy of contract. Certificate of Repossession and application for Indiana Repossession title in lien holder's name. Lien holder or repossessor must obtain title in their name to dispose of vehicle.
