Iowa is a right to cure state, this requires any lien holder to send a notice to the debtor explaining that they have 20 days to cure the deficiency on their loan or the lien holder intends to repossess the collateral if the loan is not paid contractually current. The right to cure notice stays in effect for 365 days once mailed by the lien holder. The loan must be delinquent for at least 10 days before the collateral is repossessed. The lender also has the right to repossess the collateral if the debtor has allowed their vehicle insurance to lapse provided that the right to cure notice was mailed to the debtor in the last 365 days. As always, federal law requires that the peace not be breached by the repossessor while the collateral is being repossessed. It is always a good idea to provide your repossessor with a copy of the right to cure notice sent to your debtor. Many out of state lenders get in trouble on a loans that were signed in a state that does not have a right to cure notice requirement and then their debtor moves to Iowa. The lien holder then orders a repossession without ever sending a right to cure notice. The state of Iowa does not license repossessors.
For the most part Iowans are "salt of the earth" people. They are hard working and very honest. Overall, our Iowa offices encounter far fewer repossession assignments where the lien holder was defrauded by their debtor. We are assigned two voluntary repossessions for every involuntary repossession assignment that comes in. Of course we do have excellent skip tracers that will locate anyone that goes on the run with your collateral. We have more license plate readers throughout Iowa than all the other Iowa repo companies combined. All of our repo agents are consummate professionals that focus on safety of the public, your collateral and themselves all while staying within the confines of local, state and federal laws. Please consider Speedy Repo services to handle all of your Iowa repossession assignments.
