The state of Kansas does not license repossession agents. Kansas is a right to cure state that calls for lenders to notify their customer in writing when any loan is more than 10 days past due. This right to cure notice must allow their customer 20 days to pay the account contractually current before repossessing their collateral. State law also requires that repo agents notify local law enforcement anytime a repossession has been performed. The repo agent must provide: the address the collateral was repossessed from, the license plate number of the repossessed vehicle, the VIN number of the repossessed vehicle, the name of the repossessing entity and a callback phone number. This information is required so that once the debtor discovers their vehicle is missing and calls the police to report their vehicle as stolen, the police first check the "repo log" and notify the individual that their vehicle was not stolen, it was repossessed. As always, federal law requires that the repossession agent does not breach the peace while repossessing any collateral. The Uniform Commercial code also requires the lender to provide written notice to a debtor once any collateral is repossessed. The notice must notify the consumer that: their collateral has been repossessed, the lender intends to sell the collateral at public auction, and that the debtor can prevent this from taking place and get their collateral back if they pay the balance in full within 15 days.
Kansas has a strong agricultural base which requires that Speedy Repo be prepared to repossess farm equipment on a regular basis. We are prepared with heavy duty tow trucks, cranes and trailers that can safely lift, load and haul any farm equipment that you may have a lien on. Our staff fully understands the intricacies of repossessing farm equipment. It isn't possible to sneak onto a farm and load their tractor onto your flatbed and leave without confrontation. The loading process takes to long, every farm has dogs that will alert the farmer and the repo agent will be confronted with a shotgun. Instead, we send in one of our agents in a regular vehicle, knock on the door and respectfully advise the farmer why you are there and what their rights are through the process. They will either let you take the collateral or Speedy Repo will obtain a replevin order and return with the sheriff. With decades of experience we have found this to be the most successful strategy for repossessing any farm equipment.
Of course we also repossess cars, boats, trailers RV's and ATV's. Those are our bread and butter repo assignments. We have complete coverage for repossessions throughout the state of Kansas. Please call Speedy Repo today and give us an opportunity to show you exactly why we are leaders in the Kansas repossession industry.
