Minnesota has no requirement for repossession companies or repossession agents to be licensed. Minnesota state law does require repo agents to immediately notify law enforcement as soon as a repossession is completed. Lenders are not required by Minnesota law to provide a 'Right to Cure' notice prior to repossession. The only exception occurs if the loan agreement originated in a state where these notices are legally required, as those specific state regulations would then take precedence. Federal law permits 'self-help' repossession provided it is carried out without a breach of the peace. Under the Uniform Commercial Code (UCC), lenders are required to grant debtors a 15-day right of redemption. To exercise this right, the debtor must either bring the account contractually current or satisfy the loan balance in full, at which point the lien holder must return the collateral.
