The state of Florida issues licenses for companies, repo agents and interns through the Florida Department of Agriculture and Consumer Services (FDACS). Repo agencies must hold a Class “R” Recovery Agency license. Repo agents are required to obtain a class "E" license for individuals. Intern repo agents must obtain a class "EE" license. Florida does not have any requirements for lenders to notify a consumer in advance of a repossession order being issued. Pursuant to federal guidelines and the Uniform Commercial Code (UCC), all asset recoveries must be executed without a breach of the peace. Following a successful repossession, lenders are legally mandated to grant the consumer a 'Right of Redemption.' This provision allows the debtor to reclaim the collateral by satisfying the outstanding loan balance and any associated recovery costs in full.

Florida Title and Repossession Requirements

Title State: Florida Repo Title and repossessor License information refer to: Florida Division of Repo Motor Vehicles, Neil Kirkman Building, Tallahassee, Florida 32399

Recording: With Florida Clerk of Circuit Court where repo property is first located. Uniform Commercial Code adopted January, 1967 in Florida.

Recovery: Peaceful repossession permitted in Florida.

Repossession Redemption: Debtor can redeem only prior to Florida repo sale or foreclosure by payment of entire balance to repossessor.

Repossession Deficiency: Florida Confession of judgment invalid in repossession foreclosure proceedings. Court can enter repossession deficiency judgment in Florida.

Special Motor Vehicle Provisions: Sworn notice of repo lien must be filed with Florida Commissioner of Motor Vehicles and will appear on title in lieu of general recording statute.

Florida Documents Required to Transfer Ownership of Motor Vehicle: Title must be reduced to lien holder's or repossessor name.

Florida Repo Plates: Remain with the owner or repossessor.
