Vermont does not mandate repo agents or repossession agencies obtain a state specific license to repossess collateral.  Lenders have no requirements to notify a delinquent consumer prior to repossession. This does not apply if the promissory note that pledges the vehicle as collateral was signed in a Right to Cure state. If that is the case then the laws of where the note was signed should be followed. Section 9 of the Uniform Commercial code requires that no breach of the peace occurs during the repossession process. The UCC also establishes the framework for post-repossession compliance. Lenders are required to send a certified notice to the debtor explaining their right of Redemption. Essentially, the debtor has a 15 day window to pay the loan in full and get their repossessed collateral back. If the debtor does not pay off the loan within the 15 days, the lender will auction off the collateral. If the auction proceeds are more than the loan balance the lender will cut a check to the debtor for the left over money. If the auction proceeds are less than the loan balance the lender will normally file a lawsuit for the difference.
