The state of Nevada requires that all companies and individuals performing repossessions obtain a license from the Nevada Private Investigators Licensing Board. Nevada is not a "right to cure" state so the lender does not have any obligation to inform a consumer before their collateral is assigned to be repossessed. Nevada State law does require that once a repossession agent performs a repossession they are required to notify the local police if the repo takes place in a rural area that does not have a police department the county sheriff must then be notified. This prevents law enforcement from taking a stolen report on a vehicle was repossessed. Under the Uniform Commercial Code (UCC), all repossessions must be executed without a breach of the peace. Following a recovery, federal and state guidelines require lenders to provide the debtor with a formal notice of repossession and an intent to sell the collateral at auction. This notification must advise the debtor of their 15-day right of redemption, during which they may reclaim the vehicle by fulfilling specific financial requirements. Depending on the lender's policy and the loan's status, this may require a full payoff of the balance plus recovery costs, or a 'reinstatement' where the debtor pays only the past-due amount and associated fees.
