Delaware does not license repossessors or repo companies. Delaware is not a right to cure state so the debtor does not need to be notified that the lender intends to repossess the collateral. The exception to this is that if the loan has a balloon payment in the terms of the loan, the lender must notify the debtor that they intend to repossess the collateral, auction it off and sell it. The lender must apply the proceeds from the auction minus repossession and auction costs to the balance of the debtors loan. As always federal law applies and the peace may not be breached during the repossession process. The lender must also provide the debtor the right to redeem. Where the debtor has 15 days to pay either the past due amount plus repossession costs plus valid insurance or the balance in full plus repossession costs, whichever the lien holder demands. If the payment is made in the allotted 15 days the lender must return the collateral to the debtor.
Delaware might be the smallest state, but we have a large number of license plate reader cameras across the state. We also have our chase cars equipped with cameras and a multitude of stationary Flock cameras. Every license plate reader automatically takes a picture of every license plate it sees. The picture is saved to a database along with the date, time and GPS coordinates of where the car was seen. The database is searchable by the license plate number. We can also enter a plate number into our system if we have a repo order on it. If one of our repo trucks or chase cars drives by a plate we are after, the system notifies the driver to go back and pick it up. It is a very effective way of finding cars to repo.
What separates Speedy Repo from every other repo company out there? When other companies head out for the night, each tow truck has a clipboard of 40 or 50 vehicles they are after that night. Recording: With Recorder of Delaware Deeds in county where repossession property is located. Uniform Commercial Code adopted July, 1967 in Delaware.
Recovery: Peaceful repossession permitted in Delaware.
Repossession Redemption: Debtor can redeem repossession within 15 days after taking by payment of total balance to repossessor due plus repossession fees in Delaware.
Repossession Deficiency: Delaware Confession of Judgment notes are invalid but repossession deficiencies can be collected. Repossession does not bar suit in Delaware.
