Georgia is not a right to cure state so the lender does not have any obligation to notify the debtor prior to performing a repo. The only exception to this is if the debtor signed the promissory note in a state that does require the lender to notify the debtor prior to repossessing the collateral.  The state of Georgia does not license repossession companies or individuals. Federal law does allow for self help repossession so long as the peace is not breached. The Uniform Commercial code does require lenders to provide debtors a 15 day right to redeem where the debtor is required to pay the account contractually current or pay the loan off entirely and the lien holder will return the repossessed collateral back to the debtor.

Georgia has different groups running sub leasing scams in and around the Atlanta area. If you don't know, a sub leasing scam is as follows: Someone advertises their expensive car for sale either in a newspaper or online. A scammer reaches out to the individual if the individual says that there is a lien on the vehicle and discloses how much the monthly payment is, the scammer offers to lease the vehicle off of the individual for almost triple what their monthly payment is. The scammer explains that they sub lease vehicles to individuals that make good money but don't have great credit. They claim that they will get a down payment of 1 years worth of payments, so that if the sub lessor defaults, they have a huge reserve to make their monthly payment to the bank. Yeah, it all sounds too good to be true because it is. Once the scammer has the vehicle they change their phone numbers and abscond with their car. The police won't get involved as it is a civil matter. The individuals bank tells them that they weren't authorized to sub let the car and that they better make the payments. Recording: For property brought in from another state, Repo lien must be recorded six months after brought into Georgia in order to be effective against third parties.
