Order an Illinois Repossession - Hold Harmless Agreement

The state of Illinois does require that any company or individual performing repossession services be licensed by the Illinois Commerce Commission. Illinois also requires that repossessors notify local law enforcement before any repossession is performed. The law also requires that once the repossession is completed that local law enforcement be notified within 30 minutes of the repossession being completed. Illinois is not a right to cure state, so lenders are not required to notify a consumer prior to repossessing any collateral. Exceptions to this are if the promissory note requires the lender to notify a consumer prior to repossession or if the promissory note was signed in a state that requires the lender to notify  a consumer prior to repossession. Federal law does require that there is no breach of the peace while any repossession is taking place. Lenders must provide debtors 15 days to pay the balance in full plus all repossession costs in order for the debtor to get the collateral back. This is called "The right to redeem".

Illinois Repossessor Recording: Uniform Commercial Code adopted July, 1962. Recorded in the county where mortgagor resides or where repo property is located in Illinois.

Illinois Repossession Recovery: Peaceful repossession permitted in Illinois.

Illinois Repossession Redemption: Security agreements allow 21 days prior to date of repo sale by payment in full to repossessor.

Illinois Repossession Deficiency: Confession of repossession judgment is valid. Illinois Repossession Deficiency is permitted but if debtor has paid 50% of the contract price, resale bars suit for repossessor price.

Special Motor Vehicle Provisions: All Illinois Repossession liens must be noted to be effective and title is retained by lien holder. No other Illinois repossessor recording required.

Documents Required to Transfer Ownership of Motor Vehicle: Certificate of title in repossession lien holder's name, notarized Bill of Sale. Illinois Repossession Liens are released on the face of the title.
