South Carolina does not have a specific license for repo companies or repo agents. South Carolina is a right to cure state, so lenders are required to send a notice to their customer in advance of repossession. Once an account is at least 10 days past due lenders must send a notice giving their customer a minimum of 20 days to catch up on missed payments. The notice should also explain that if the loan is not paid contractually current after the 20 days the lien holder has the right to repossess the collateral. The notification should be sent by certified mail so that the lien holder can prove that they sent the notice within the prescribed guidelines. Pursuant to the Uniform Commercial Code (UCC), all asset recoveries must be executed without a breach of the peace. Additionally following a successful repossession, lien holders are mandated to provide debtors with a formal notice via certified mail regarding their Right of Redemption. This notification must detail the scheduled public auction and specify the exact payoff amount required to reclaim the asset. Furthermore, the notice must stipulate that if the loan is satisfied in full within 15 days, the lender is obligated to return the collateral to the consumer.

South Carolina Repossession Recording: Must be filed within 10 days in the county where buyer or mortgagor resides; if non-resident, where repo property is located at time of execution of instrument. The place of recording in the office of the Registrar of South Carolina Repossession Conveyances; where such office does not exist, with the Clerk of the Court. Uniform Commercial Code adopted January, 1968.
